Terms of Service

These Terms of Service ("Terms") govern your access to and use of MarkDB (the "Service"). By using the Service you agree to these Terms.
1. The Service
MarkDB is a memory database for AI agents. It operates as a proxy between your client and third-party model providers, capturing the requests and responses you route through it into a memory store that you can search and summarize.
2. Accounts and API keys
You are responsible for safeguarding your account credentials and API keys, and for all activity that occurs under them. Notify us promptly of any unauthorized use. You must be at least the age of majority in your jurisdiction to use the Service.
3. Your content and data
"Your Content" means the prompts, messages, tool calls, responses, and other data you route through or submit to the Service. You retain ownership of Your Content. You grant us a limited license to process, store, transmit, and otherwise use Your Content solely to provide and improve the Service for you -- including capturing it as memory, generating summaries, and building search indexes.
You are responsible for ensuring you have the rights necessary to submit Your Content and that doing so does not violate any law or third-party right.
4. Third-party model providers
When you route a request through the Service, we forward it to the model provider you select (for example, Anthropic, OpenAI, or Google). Your use of those providers is also subject to their terms and policies. We are not responsible for the outputs, availability, or conduct of third-party providers. You are responsible for the model credentials you configure and any charges they incur.
5. Acceptable use
You agree not to use the Service to:
- violate any law or regulation, or infringe any third-party right;
- send content that is unlawful, harmful, or that you are not authorized to process;
- attempt to gain unauthorized access to the Service, other accounts, or our systems;
- interfere with or disrupt the integrity or performance of the Service, or circumvent its rate limits or security;
- resell or sublicense the Service without our written consent.
6. Fees
If the Service offers paid plans, fees and billing terms will be presented at sign-up or in your account. Charges incurred with third-party model providers through your configured credentials are your responsibility.
7. Availability and changes
We strive to keep the Service available but do not guarantee uninterrupted operation. We may modify, suspend, or discontinue features, and we may update these Terms. Material changes will be reflected by updating the "Last updated" date; your continued use after changes take effect constitutes acceptance.
8. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or to protect the Service or other users. On termination, your right to use the Service ends; provisions that by their nature should survive will survive.
9. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Model outputs may be inaccurate; you are responsible for reviewing them before relying on them.
10. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or revenue, arising out of or relating to your use of the Service.
